This approach offers advantages, including greater control over outcomes, reduced costs, faster resolution, and decreased emotional stress. In many Texas counties, mediation is required before trial. How is property divided in a Texas divorce?

Texas is a community property state, meaning assets and debts acquired during marriage are generally considered jointly owned. However, this does not automatically mean a 50/50 split. Separate property – assets owned before marriage or received as gifts or inheritance –typically remains with the original owner if properly documented.

When is spousal support awarded in a Texas divorce?

Texas has specific eligibility requirements for spousal maintenance. To qualify, the marriage must generally have lasted at least 10 years and the requesting spouse must lack sufficient property or income to meet minimum reasonable needs. Alternatively, spousal support may be awarded if the requesting spouse has a disability, is the custodian of a child with a disability or has experienced family violence. The amount is typically capped at $5,000 monthly or 20% of the paying spouse’s average monthly gross income, whichever is lower.

How is child custody awarded in a Texas divorce?

Texas courts make custody decisions based on the “best interest of the child” standard. The state encourages parents to share in the rights and duties of raising their children when possible. The standard possession order typically provides the non-primary parent with visitation on first, third, and fifth weekends, Thursday evenings, alternating holidays and extended summer time. Courts consider factors including parenting abilities, stability, child’s needs and any history of domestic violence when making custody determinations.
