Prenuptial agreements have a bad reputation. If a future spouse asks his or her partner to sign one, feelings of mistrust may arise. Words like “gold digger” and phrases like “don’t you trust me?” have become natural reactions to these kinds of contracts. People feel uncomfortable signing or even discussing the possibility of creating a prenuptial agreement because of its negative connotations.

However, prenuptial agreements are far from compromising when it comes to marriage. As this article explains, prenuptial agreements are similar to insurance. It is a great safety net for all involved, but it is even better if you never need to use it.

Like it or not, marriage is not an infallible institution. It requires work, compromise and sacrifice to last. Even then, people change and circumstances change. Marriages will not always work, no matter how hard a couple tries. Having a prenuptial agreement is not a self-fulfilling prophecy, and you may end up glad you had done it in the end.

There are additional benefits for getting a prenuptial agreement. They create an open line of communication where you and your spouse can discuss important things like each other’s financial goals, expectations for the relationship and plans for the future. These things must be discussed prior to marriage. Having a formal, structured way to do so will make for a smoother and more constructive conversation, and will ensure that this conversation actually occurs.

Of course, prenuptial agreements that are not legally binding are not as effective. Consulting an experienced lawyer during this process may be best to help you and your spouse through this process.
